USER TERMS FOR STICKER FORCE
(‘Terms’) 

1. How It Works: The Services

Our website, www.stickerforce.au operates on a Shopify platform and allows you to design your own stickers and purchase custom sticker products (‘the Services’). We use a third-party plugin operated by an overseas provider that enables instant quoting, edits of designs, producing a preview and generating a print ready file. The plugin forms part of the ordering path. When your project is completed, you have approved the final design and your payment is made, we receive your order details and print ready file, produce the final stickers and send them to you.

You acknowledge that third party providers assist in supplying parts of the Services and we are not responsible for their acts or omissions except as required by Australian Consumer Law (‘ACL’).

2. Artwork Disclaimers

Pixelation Disclaimer: Print quality depends on the artwork you supply and the quality shown in your proof. If your proof looks pixelated, the final print will look pixelated as well. For the best results, please provide high-resolution images and designs.

Artwork Scale Disclaimer: We aim to produce your stickers to the highest quality. When setting up your artwork, we enlarge it as much as possible within your selected dimensions while keeping the original proportions. To preserve scale and quality, the final sticker may be slightly smaller than the size ordered. We will never stretch or distort your artwork.

If you are unsure how your artwork will scale, we strongly recommend requesting a print proof so you can review the final size before production starts.

3. Uploading Images, Logos and Other Content

You may upload photos, artwork, logos, illustrations, text or other materials to create your sticker design. By uploading content, you warrant that you either own the content outright or have obtained all necessary rights, licences, consents or permissions to use, modify and reproduce it. Please review our separate Copyright and Upload Guidelines carefully prior to uploading any files.

You grant us a non-exclusive, worldwide, royalty free licence to use, reproduce, modify, adapt, print and store your uploaded content for the purpose of providing the Services, fulfilling your order and keeping appropriate records. We do not acquire ownership of your content.

You must not upload any content that is unlawful, obscene, defamatory, abusive, harmful, infringing or otherwise inappropriate. We may refuse to process an order or remove content if we believe it may infringe rights, breach these Terms or expose us to legal or reputational risk.

4. Prohibited Technical Content and File Integrity Requirements

You must not upload any files that are corrupted, incomplete, infected with viruses or malicious code, or capable of damaging, disrupting or impairing our website, editor, servers, software or the third-party plugin. You must not upload any executable files, scripts or any file type that may reasonably be considered unsafe or designed to interfere with the operation of the website or the Services.

You agree that any attempt to upload harmful or corrupt files may result in immediate suspension of your access to the Services and may expose you to legal liability.

5. Creating Projects and Using the Editor

After selecting a product on our website, the design tool is activated as the second step in the purchasing process. You can upload your content and generate a suggested design using AI. You may make changes to your personalised product in editor mode and review the preview in real time.

Once you accept the project in editor mode, you will be redirected to the summary page to make payment. By accepting the project and chosen design, you confirm the design is accurate, final and ready for printing.

6. Payment and Order Process

Once you initiate a manual proof, you may include any special requests or requirements in the Notes Box.  All special requests or requirements are handled on a best efforts basis. You will receive any revised files to confirm and approve prior to printing.

Payment methods are provided at checkout and are not linked to the design tool. If full integration is used, we only receive information on the transaction status to generate and deliver the print ready file.

Your order is confirmed once payment is successfully processed. After payment and confirmation of your project, the order is submitted to production. You cannot cancel, make changes, modifications or variations to your order after you have confirmed it.

If your artwork is unclear or has any issues, we will contact you to explain the problem and suggest ways to make it suitable for printing. If the artwork cannot be made printable, we will refund your order minus any card processing fees. From artwork approval and confirmation, your sticker order will be processed and ready for dispatch within 5 business days or less, excluding weekends and public holidays.

Please note: Delivery times depend on your location in Australia. Once your order has been sent via Australia Post, exact delivery timeframes are outside our control and you will need to check with your local Australia Post office.

7. Printing Variations and Final Output

You acknowledge that the final printed product may not appear exactly the same as the design you approved in the editor. Variations can occur due to differences in screen displays, device settings, colour profiles, print processes, materials, finishes and other technical factors. Colours, tones, sharpness, contrast and placement may appear slightly different once printed. Minor variations of this nature are not considered defects and do not entitle you to a refund, replacement or reprint unless required under the Australian Consumer Law (‘ACL’).

You agree that it is your responsibility to review the design carefully before approving it in the editor and that the printed product will be produced as closely as reasonably possible to the approved design, subject to acceptable and industry standard printing variations

8. Refunds, Returns and Changes of Mind

You are solely responsible for determining whether the product is suitable for your purposes. We do not warrant that the product will meet your expectations.

We cannot accept cancellations or refunds for change of mind once your order has been confirmed by you and processed. Our products are custom made according to your uploaded content, chosen settings and approved design. For this reason, refunds for change of mind are not available.

If we agree, at our sole discretion, to change or cancel your order outside our obligations under the ACL, an administration fee may apply.

We at all times comply with our obligations under ACL and your statutory rights are set out below.

9. Australian Consumer Law (ACL)

Our products come with guarantees that cannot be excluded, restricted or modified under the ACL. If a product fails to meet a consumer guarantee, you may be entitled to a return, refund or replacement.

If a product arrives damaged, is incorrect, is defective or is not as described, you must contact us immediately with your order details and clear photographs so we can assess the issue. If you are entitled to a remedy under the ACL, we will assist you in arranging a replacement or refund as we may deem appropriate.

We will cover the cost of return shipping and freight fees and the cost of shipping any replacement product to you in the event that you are entitled to a replacement under the ACL. Please contact us directly prior to sending any products back to discuss the options available and how we may address any concerns you may have.

10. Third Party Services and Integrations

We integrate with third-party software providers who supply the AI design tool and certain automated functions. Although we take reasonable steps to ensure these services operate reliably, we do not control them and are not responsible for their performance, availability, accuracy or outputs.

You use all third-party services at your own risk and must comply with their terms and policies.

11. Intellectual Property

All intellectual property in our website, branding, product designs, templates, layouts, graphics, images, software and content remains ours or our licensors. You may only use our intellectual property as necessary to access and use the website and Services.

Nothing in these Terms transfers ownership of our intellectual property to you.

12. Indemnity

You indemnify us and hold us harmless from and against all loss, damage, liability, claim, demand, cost or expense arising out of or connected with your uploaded content, including any claim that your content infringes copyright, trademark, moral rights, privacy rights or any other rights of a third party, any AI generated material incorporated into your final design that is alleged to infringe the rights of a third party or that is alleged to be unlawful, offensive or misleading, your breach of these Terms including your warranties in relation to content, permissions and intellectual property rights, your misuse of the website, the editor, AI functionality or the Services, and any claim brought against us that arises from your final approved design or your use of the printed product.

This indemnity continues after your relationship with us ends.

13. Prohibited Conduct

You must not misuse the website, interfere with its security or attempt to access our systems without permission. You must not upload harmful, infringing or inappropriate content or use the Services for unlawful purposes.

14. Delivery, Shipping and Risk

Once your order is printed, we will ship it to the delivery address you provide. Risk passes to you upon dispatch. Title passes upon delivery.

You must check all delivery information is correct before ordering. We are not responsible for delays or losses caused by incorrect delivery details or courier issues.

15. Limitation of Liability

To the maximum extent permitted by law we are not liable for indirect, incidental, special or consequential loss, loss of profits, loss of data, loss of goodwill or business interruption arising from your use of the website, AI functionality, uploaded content, third party integrations or the Services.

We are not liable for any claim arising from AI generated content, your uploaded content or any alleged infringement connected with your final design.

Our total liability for any claim is limited to the total amount paid by you for the relevant order. Nothing in these Terms limits liability where it is unlawful to do so.

16. Privacy and Data Handling

We collect personal information necessary to process your order, generate your project and deliver the Services. We may receive limited transaction data from the plugin to generate your print file. All personal information is handled under our Privacy Policy on our website.

17. Account, Access and Termination

We may suspend or terminate access or refuse an order if you breach these Terms or your content or conduct poses a risk to us or others.

18. Governing Law

These Terms are governed by the laws of the State of Victoria in Australia in which we are based and you submit to the exclusive jurisdiction of those courts in the event of any dispute.

19. Changes to These Terms

We may update these Terms at any time. The version available at the time you place your order will apply to that purchase. Please ensure you return to check our Terms and any modifications to the Terms each time you use our website and Services.

These Copyright and Upload Guidelines explain your responsibilities when uploading files, artwork, images, text or other materials to our website or sticker editor (‘Services’). By uploading content, you agree to comply with the following guidelines.

Ownership and Permission Requirements

You must only upload content that you own or have full permission to use. This includes photographs, illustrations, artwork, designs, brand names, business names, logos, character images and any other materials (‘Content’). If your Content includes people, you must have permission from any individuals featured. If your Content includes any business or brand logo, character, graphic or copyrighted material, you must have written permission from the owner or rights holder.

No Infringing or Unlawful Content

You must not upload any Content that infringes third party copyright, trade marks, moral rights, publicity rights or any other intellectual property rights. You must not upload images copied from the internet, screenshots, characters or artwork created by others, or any Content belonging to third parties unless you have obtained appropriate rights to use and reproduce it.

You must not upload any content that is harmful, obscene, defamatory, abusive, misleading, deceptive or unlawful. You must not upload Content that breaches privacy, confidentiality or any other legal restrictions.

File Safety and Technical Integrity

You must ensure that any files you upload are technically safe and suitable for use. You must not upload corrupted files, incomplete files, or files infected with viruses or malicious code. You must not upload any file that is capable of damaging, disrupting or impairing our website, the design editor, our servers, our software or the third-party plugin.

You must not upload executable files, scripts or any file designed, intended or reasonably capable of interfering with the operation or security of our systems or the Services. Uploading harmful or corrupted files may result in immediate suspension of your access to the Services and may expose you to legal liability.

Your Responsibility for Uploaded Content

You are solely responsible for the Content you upload and for the final design you approve. We do not review, monitor, verify or approve uploaded content for legal compliance, rights clearance, accuracy, quality, file safety or technical integrity. We rely entirely on your warranties that you hold all necessary rights, permissions and authority to upload and use the content and that your files are complete, safe and technically suitable for processing.

If we believe your uploaded Content may be infringing, unsafe, corrupted or inappropriate, we may refuse to process your order or remove the content. However, we are not required to screen, review or analyse any files and our failure to identify an issue does not limit your responsibility.

Printing and Consequences of Uploading Unauthorised or Unsafe Content

Your final approved design will be printed as close as possible to the approved image design. Uploading Content without the required rights, or uploading technically defective files, may expose you to legal claims or may prevent us from completing your order.

You indemnify us against any claim, loss, liability, damage, cost or expense arising from your uploaded Content, including claims for intellectual property infringement, breach of privacy, technical harm to our systems or any breach of these guidelines.

If you are unsure whether you hold the required rights, or whether a file is technically safe or suitable, you should seek independent advice before uploading or approving any design.
